Abstract

The Kulbary phenomenon has always been followed by the general policies of the criminal system, because it has faced a lot of hardship and difficulty and high risks, and many residents of border regions turn to it to escape unemployment. Today, this phenomenon, in addition to being a serious threat to free trade, imposes a lot of costs on the country's economic body. In this paper, using library method, we examined the main question that the dominant aspect of Iran's criminal policy toward the Kulbari phenomenon is based on repressive or preventive measures? The findings indicate that it seems that the dominant aspect of Iran's criminal policy toward the Kulbari phenomenon is based on preventive measures. The findings also showed that there is no precise definition of the concept of Smuggling in legal texts, which can add to the ambiguity about the criminality of this phenomenon.
