Abstract
denigration means defaming a person. In the new laws approval is the concept of publishing the names and pictures of accused or criminals, with the aim of deterring, punishing, identifying and scandalizing, and it has a jurisprudential and legal history . , This is despite the fact that the legislator, in recent laws, by distancing himself from jurisprudence and legal foundations, with conditions, issued it to the accused and by canceling the law on protective and educational measures, assigned it to dangerous criminals with a history and negative effects and Irreparable social and family disasters have left it in oblivion. The important question is that what position denigration has in the criminal policy of Iran and Islam and what extent is it effective and can it be extended to all crimes or not? denigration, in the sense of public announcement of the criminal with the description of scandal, is against the criminal policy of Islam and Iran, and due to the need to preserve the personality and dignity of individuals, it is not used except in cases of necessity and there is more important expediency, and it is limited to the cases prescribed by Sharia. According to the scientific progress and the development of human society, it is not possible to implement the old methods such as turning the criminal in the city, and its negative personal and social effects in terms of destroying the character of the criminal and the accused and their families are irreparable. The author's suggestion is to remove it from the series of punishments in order to preserve human dignity and reduce its destructive effects. and be considered as an alternative punishment or a protective and educational measure with special restrictions.
