Abstract
Petty crimes are important issues of criminal law that have not been studied much. Due to the high volume of these crimes, they have a negative impact on the standards of human rights of citizens. Dealing with petty crimes and reducing its human rights effects is one of the important issues that needs to be discussed. The purpose of this article is to examine diversion of minor crimes in jurisprudence and criminal law and its impact on human rights standards. The present article is descriptive and analytical, and the mentioned question has been investigated using the library method. The findings indicate that, basically, in Iran, the legislator has not provided a definition of petty crimes, while the tendency to divide crimes into petty and severe crimes is not visible in Iran's legislative developments. Based on this, the legislator has not taken a special approach in this respect. Abolition of justice is paid attention in jurisprudence and arbitration, negotiation, peace and compromise, covering up mistakes and ignoring are the most important methods of abolition. In Iran's criminal law, mediation is one of the most important means of diversion. Reducing the delay of the proceedings and increasing the speed of the proceedings, recognizing the position of the victim in the criminal justice system, making the criminal proceedings more humane and reducing the consequences of the abuse of the judicial courts and reducing the criminal intervention are among the most important effects of diversion, which play an important role in respecting the standards of rights.
