Abstract
One of the sensitive and important topics in the formal rules of legal systems is the discussion of evidence and how to cite and accept them to prove or reject private or criminal claims. In a way that it can be rightly said that without evidence, it is not possible to prove the claim. Now, with the expansion of information technology in all aspects of human life, it cannot be claimed that the use of technology in the execution of prison sentences or the documents and documents resulting from the functions of this technology have no place to prove claims about it. The aim of the current research is to investigate the reliability of electronic evidence, the necessity of using technological tools in the control and execution of the punishment of those sentenced to imprisonment, the harms of implementing this method and how electronic controls of those sentenced to imprisonment are written in a descriptive and analytical method. The results show that in Iran's criminal law, electronic surveillance is unprecedented, and for the first time, this measure has been considered in the new Islamic Penal Code and the Criminal Procedure Law in compliance with French law. Therefore, all kinds of electronic evidence in The format of documents, testimony can be among the effective technologies in the approach of technological reform and revision in the case of proceedings with technology along with electronic monitoring instead of imprisonment.
