The principle of minimum criminal law can be considered as one of the foundations of the right not to be punished. The principle of minimality of criminal law, by creating a balance between the power of the government and the rights of citizens, emphasizes the minimal use of criminal law by governments. In the audience's article, the question of how to examine the principle of minimum criminal law from an economic point of view is discussed. This article is descriptive and analytical and has investigated the mentioned question by using the library method. A finding of the research indicates that the criminal justice system, according to the allocated budget, spends every year in the two sectors of crime prevention and fighting and responding to delinquency. Some of these costs in the prevention sector are related to the reduction of criminal situations and others are to raise the level of awareness of people in the society. In addition, the criminal justice system in many countries implements special programs every year to combat the phenomenon of delinquency. These programs, according to their type and nature, impose costs on the society. The costs of different parts of the criminal justice system are different. Different institutions of the criminal justice system can reduce the cost of other departments through appropriate performance or, on the contrary, impose additional costs on other departments due to unfavorable performance.
