The purpose of this article is to examine the question of what is the approach of jurisprudence and criminal law towards abortion caused by rape? This article is descriptive and analytical .The results indicate that if the pregnancy is due to rape, the majority of Sunni jurists and some of the Emami jurists consider it permissible to abort before conception. Of course, a number of Emamiyyah jurists consider abortion caused by rape to be haram even before the soul is breathed. This is despite the fact that everyone considers it haram to abort the soul after it has been breathed. In legal terms, with the recent law to protect the youth of the population, abortion caused by rape is practically not allowed. This is while the child resulting from rape creates major challenges in the society for both the mother and the child. First, a woman who has been raped needs support as a victim, but she is forced to keep the fetus resulting from rape against her reluctance. For this reason, the responsibility of taking care of the newborn baby is probably handed over to nurseries. The non-permissibility of abortion caused by rape is also a problem for the child. He does not have the rights of other children. For example, the lineage of a child is an illegitimate lineage that will not be supported by the legislator in terms of attribution to parents. In the matter of inheritance, he does not inherit from his parents.
