Crimes against cultural heritage as crimes against society or against public peace with the aim of harming the cultural-historical heritage of the countries that tell the spiritual message of the past and the historical course of transformation and evolution of humans, which are considered one of the most important and major economic-international crimes. The aim of the current research is to investigate crimes under headings such as smuggling, illegal exploration and excavations, theft of antiques, which have been analyzed with descriptive and analytical methods of legal mechanisms in the protection of cultural heritage. The findings show that in Iran, due to the common characteristics of the national policy of the countries in the necessity of protecting human interests and the national history, this crime has been considered as a crime against national security. Based on this, in relation to crimes against historical and cultural property, Iran's Islamic Penal Code, in Chapter 9, specifically provides various punishments for the destruction of historical and cultural properties, their theft or sale, as well as the removal of historical properties from the country, unauthorized digging and exploration, and even those who accidentally find artifacts but refuse to hand them over, transfer ownership and change of use, and even fraud in cultural and historical artifacts.
