Crimes against the moral dignity of individuals in cyber space is one of the crimes that has become more widespread with the increasing growth of the Internet and its use. This has made the examination of criminal policy in this regard a necessity. The purpose of this article is to firstly identify the fundamentals and principles governing judicial criminal policy in crimes against moral dignity in cyberspace and on the other hand, to examine the challenges that exist in this criminal policy. The current article is descriptive and analytical and has investigated the mentioned subject by using the library method. The findings indicate that the judicial system of the country has been in the direction of absolute justice in its criminal policy, especially in the crimes against spiritual dignity in cyberspace, without considering utilitarianism in the application of punishments. The extent of committing crimes, the lack of transparency in the laws, the lack of coordination between legislative and judicial and executive criminal policy, have caused confusion in adopting a proportionate criminal policy. At the same time, the failure to adopt a discriminatory criminal policy and appropriate punishment based on the existing realities in the cybercrime environment has caused the lack of a single judicial procedure and also the division of votes, which has resulted in the delay of the proceedings and also the lack of Rights of the victims of crimes against moral dignity will be followed.
