The present study aims to investigate the criminalization of abortion with an emphasis on the law on the youth of the population and protection of the family and international regulations in a descriptive analytical way. The obtained results indicate that the issue of abortion has not been criminalized in the law of population youth and family protection, and it has not been compatible with international human rights regulations. Article 53 of this law deals with screenings and severely limits them. Basically, the screening of diseases that lead to the birth of a baby with an incurable disease is prohibited in the plan, and in addition, doctors and health workers are not obliged to recommend screening, and this task has been removed from the shoulders of the health system, including doctors at all levels. In this situation, if the doctor or health system staff do not recommend screening and finally a baby is born with an incurable disease, the baby's family cannot follow up on this issue and the lack of doctor's recommendation. Also, policies encouraging childbearing due to poverty in the society, as well as strictness in the issue of abortion, increase the possibility of an increase in congenitally defective children, thus complicating the debate and denying the right to choose not to give birth to a baby with abnormalities through difficult treatments.
