The development of today knowledge of human in enjoyment from the technology of genetic changes besides genetic manipulation of genetic datas in order to facilitate treatment of incurable diseases such as: all types of cancers, cardiovascular diseases, infectious diseases, hereditary diseases, hemophilia, diabetes, AIDS or breeding of some plants, fruits and animals and even the production of medicinal plants with high quality and purity in the form of combination of Medical Science and Technology results in the advent of novel biotechnology of »genetic engineering« that in this research specially Iran’s criminal policy in comparison with damages of »gene therapy« as one of the branches of genetic engineering as main goal of this research will be surveyed. In response to main question of this research based on this point that if Iran’s Legal System has made binding strategies in prevention from or comparison with crimes and infractions resulted from genetic engineering and gene therapy? After gathering information with library method besides benefit from articles and valid scientific books related to medical law, biological ethics, biotechnology and genetic engineering, it is worth noting that Iran’s criminal policy has legislative and non-legislative approaches with deterrence approach from each kind of abuse and infraction of legal and natural person from novel technology of genetic engineering and gene therapy and even remunerative approach of each of violators of legitimate freedoms and rights of involved or sick people in the process of genetic engineering and gene therapy that has been surveyed as conclusions of this research with descriptive and analytical method and determination of the legal vacuums in Iran’s legal system in comparison with adverse effects of genetic engineering and gene therapy is practically researchable in order to make novel executive strategies in form of new criminal policy.
