چکیده
نظام جمهوری اسلامی ایران الگویی منحصربه‌فرد از حکمرانی ارائه می‌دهد که جمهوریت و ولایت فقیه را در چارچوبی واحد تلفیق کرده است. این مقاله با رهیافتی پدیدارشناسانه، به تحلیل نحوه ظهور و تبلور این دو مفهوم در قانون اساسی جمهوری اسلامی ایران می‌پردازد و این پرسش را مطرح می‌کند که آیا ولایت فقیه را می‌توان به‌مثابه نهادی مستقل و هم‌طراز با الگوهای مرسوم حکمرانی، همچون نظام‌های ریاستی و پارلمانی، تلقی کرد، یا آنکه این اصل در ذات خود متضمن ساختارشکنی در مدل‌های کلاسیک دولت مدرن است.

پدیدارشناسی حقوقی نشان می‌دهد که جمهوریت در نظام جمهوری اسلامی نه صرفاً به‌مثابه یک شکل اجرایی حکمرانی، بلکه به‌عنوان مفهومی پدیداری در نسبت با ولایت فقیه معنا می‌یابد؛ به‌گونه‌ای که در عین پذیرش نقش مردم در مشروعیت‌بخشی به حاکمیت، ساختار ولایت فقیه به‌عنوان محور انسجام سیاسی و فقهی، ماهیت جمهوریت را در چارچوبی متفاوت از دموکراسی‌های لیبرال بازتعریف می‌کند. اصل پنجاه و هفتم قانون اساسی، با تأکید بر ولایت مطلقه فقیه، حکومتی را ترسیم می‌کند که در آن اقتدار فقهی ولی فقیه نه‌تنها بر فرآیندهای اجرایی و تقنینی سایه افکنده، بلکه با عبور از تفکیک قوای کلاسیک، حکمرانی را به ساختاری با مرکزیت فقه سیاسی شیعه تبدیل کرده است.

تحلیل پدیدارشناسانه این ساختار نشان می‌دهد که نسبت جمهوریت و ولایت فقیه، در مقام تجربه زیسته‌ی نظام حکمرانی، انسجام مشروعیت دینی-سیاسی را تقویت کرده است، اما هم‌زمان پرسش‌هایی را درباره میزان انطباق آن با شاخص‌های حکمرانی مطلوب، ازجمله مشارکت، پاسخگویی و تحدید قدرت، برمی‌انگیزد.

چکیده English

The Islamic Republic of Iran presents a unique model of governance that integrates republicanism and the Guardianship of the Jurist (Velayat-e Faqih) within a unified framework. Adopting a phenomenological approach, this article examines how these two concepts manifest in the Iranian Constitution and raises the question of whether Velayat-e Faqih can be conceptualized as an independent institution parallel to conventional governance models, such as presidential and parliamentary systems, or whether it inherently disrupts classical state structures.

Legal phenomenology suggests that republicanism in the Islamic Republic is not merely an administrative form of governance but a phenomenological construct that derives meaning in relation to Velayat-e Faqih. While the system acknowledges the role of the people in legitimizing authority, the centrality of Velayat-e Faqih reshapes the concept of republicanism within a framework distinct from liberal democracies. Article 57 of the Constitution, which emphasizes the Absolute Guardianship of the Jurist, delineates a structure in which the jurist's religious authority not only influences executive and legislative processes but also transcends the classical separation of powers, thereby reconfiguring governance around the principles of Shi’a political jurisprudence.

A phenomenological analysis of this structure reveals that the interplay between republicanism and Velayat-e Faqih has reinforced the religious-political legitimacy of the system. However, it also raises critical questions regarding its compatibility with the principles of good governance, particularly in terms of political participation, accountability, and the limitation of power.
