Legal protection entails the establishment and consolidation of sufficient safeguards to secure such protection, employing mechanisms that ensure the rights and freedoms enshrined in the constitutional document are shielded from encroachment, violation, or infringement. This is achieved through the national legislator’s regulation of the relevant activities and procedures via legal provisions. The 2005 Constitution of the Republic of Iraq—currently in force—addresses the granting of citizenship in a manner that upholds the principle of equality between men and women. This reflects a commitment to human rights and aligns with international conventions to which Iraq is a party; the Constitution grants both men and women equal standing in transmitting Iraqi citizenship to their children. This approach embodies ideal principles in this domain, recognizing citizenship as a fundamental human right—akin to the rights to life, security, and work.
